This website contains information regarding a class action pending to determine restitution in the Superior Court of California, County of Los Angeles entitled Audrey Medrazo v. Honda of North Hollywood, Case No. BC 354744.
NATURE OF THE CLASS ACTION
In this lawsuit Bill Robertson & Sons dba Honda of North Hollywood (Honda of North Hollywood) has been found to have violated the provisions of the California Vehicle Code that required Honda of North Hollywood to place a notice on new motorcycles, that were offered for sale, disclosing to consumers the charges for destination fees, freight and preparation or delivery fees (“added charges”), over and above the Manufacturer’s Suggested Retail Price of the motorcycle.
During phase one of the trial, known as the liability phase, the Court determined that Honda of North Hollywood failed to comply with California Vehicle Code §§ 11712.5(a) and 24014 requiring that a hanger tag that disclosed any “added charges” and that the charges be “separately itemized” as part of any advertised price. Based on these findings, the Court is now seeking to determine, in phase two of this case, known as the damages phase, who is entitled to recover for the undisclosed, added on, charges. THE CLASS
The Class includes all consumers who purchased a new Honda, Suzuki or Yamaha motorcycle from Honda of North Hollywood between August 1, 2002 and September 1, 2009 that was offered for sale without the State of California required hang tag, on the motorcycle, disclosing the added on charges.
