UPDATE
If you received a notice of non-renewal from Farmers Group, Inc., Farmers Underwriters Association, Fire Underwriters Association, Farmers Insurance Exchange, or Fire Insurance Exchange and you requested exclusion from the Settlement Class in The State of Texas v. Farmers Group, Inc., Cause No. CV202501, you may be a member of a certified class action entitled: Sandra Geter v. Farmers Group, Inc., Farmers Underwriters Association, Fire Underwriters Association, Farmers Insurance Exchange, and Fire Insurance Exchange, Cause No. E-167,872, which is pending in the 172nd District Court of Jefferson County, Texas (Geter Class).
The Court has ordered that Geter Class members be provided with this additional notice to inform them of: (1) Class Counsel’s motion for an award of attorneys’ fees and costs; (2) the date of the jury trial and hearing that will be held to determine whether the motion should be approved; and (3) Class members’ right to object to the motion.
- Class Counsel, Reaud, Morgan & Quinn, The Reaud Law Firm, and The Law Office of L. DeWayne Layfield PLLC, have filed a motion with the Court for attorneys’ fees in the amount of $3,075,765 and reimbursement of expenses in the amount of $575,000 or less. Actual fees incurred on behalf of the Geter Class through August 22, 2014, are $841,165. These fees and costs are being requested to compensate Class Counsel for their work in the litigation on behalf of the Geter Class. If approved, these fees and expenses will be paid by the Defendants.
- A jury trial and hearing will be held on March 2, 2015 at 9:00am in the 172nd Judicial District Court of Jefferson County Texas, located at the Jefferson County Courthouse, 1001 Pearl Street, Beaumont, Texas 77701. At the hearing a jury and the Court will decide whether to approve Class Counsel’s motion.
- Geter Class members can object to the motion for attorneys’ fees and costs. You can give reasons why you think the Court should not approve it. The Court will consider your views before making a decision. To object, you must prepare and sign a written objection stating that you object to Class Counsel’s Motion for Attorneys’ Fees and Costs in Sandra Geter v. Farmers Group, Inc., et al., Cause No. E-167,872. The objection must be signed and include all of the following information: (1) Cause No. E-167,872; (2) your full name, current address, and telephone number; (3) a statement confirming that you are a Geter Class member and you did not previously request exclusion from this case; and (4) the reasons why you object to the motion. You must file your written objection with the Clerk of the Court and Class Counsel no later than November 17, 2014.
